Proposed Local Law #3 of 2017
RESOLUTION OF THE WEBSTER TOWN BOARD SCHEDULING A PUBLIC HEARING TO CONSIDER A NEW LOCAL LAW ADOPTING THE PROVISIONS OF CHAPTER 85 OF 2017 OF THE LAWS OF THE STATE OF NEW YORK, PART B OF WHICH IS KNOWN AS THE “LAKE ONTARIO AND CONNECTED WATERWAYS ASSESSMENT RELIEF ACT”
At a regular meeting of the Town Board of the Town of Webster, Monroe County, New York, held at the Town Board Meeting Room, 1002 Ridge Road, in the Town of Webster, New York on the 3rd day of August, 2017, at 7:30 p.m., there were present:
Supervisor Ronald W. Nesbitt
Councilman William G. Abbott
Councilwoman Patricia T. Cataldi
Councilman Barry A. Deane
Councilwoman Alecia J. Mazzo
The following Resolution was offered by Councilman Abbott and moved its adoption:
WHEREAS, the Town Board has the authority pursuant to Article 9 of the New York State Town Law to enact, amend, and repeal ordinances, rules, and regulations not inconsistent with law; and
WHEREAS, the Town Board has the authority pursuant to Articles 2 and 3 of the New York State Municipal Home Rule Law and §64 of the N.Y.S. Town Law to adopt and amend local laws, consistent with the N.Y.S. Constitution and general State laws, in relation to the property, affairs and government of the Town; and
WHEREAS, the Town Board has the authority pursuant to Articles 4 of the New York State Town Law to manage and control the finances of the Town of Webster, and to promote the health, safety, morals, or general welfare of the community, including extending potential governmentally-approved benefits to those property owners who have suffered unforeseen and unexpected damages to their residences; and
WHEREAS, it is both in the public interest and required by law that a Public Hearing be held to consider a Local Law permitted by the State Legislature of New York, and approved by that body and by the Governor of the State of New York; and
WHEREAS, both houses of the State Legislature having passed, and the Governor having approved, and therefor enacted Chapter 85 of the Laws of the State of New York for the year 2017, which law, in Part B thereof may extend benefits to certain property owners within the Town of Webster; and
WHEREAS, these benefits include the provisions of assessment relief for real property impacted by flooding within the Town of Webster, as set forth and pursuant to Sections 3 and 4 of Chapter 85 of the Laws of 2017 of the State of New York; and
WHEREAS, the Public Hearing on the proposed new Local Law shall be held by the Webster Town Board on August 17, 2017 at 7:30 p.m., and all interested persons will have an opportunity to be heard at the Public Hearing; and
WHEREAS, a short Environmental Assessment Form (EAF) for the proposed action will be prepared, and will be submitted to the Town Board and reviewed by the Town Board; and
WHEREAS, it is in the public interest and required by law that a Public Hearing be held to consider the proposed Local Law:
NOW, THEREFORE, be it RESOLVED:
1. That a Public Hearing shall be scheduled, and conducted at a regular meeting of the Town Board of the Town of Webster to be held at the Town Board Meeting Room, 1002 Ridge Road, in the Town of Webster on Thursday, August 17, 2017, at 7:30 p.m., to consider enactment of proposed Local Law No. 3.
2. Such Proposed Local Law is to be designated as:
Proposed Local Law # 3 of 2017
3. That the determination of significance under the New York State Environmental Quality Review Act will be considered at the time of such Public Hearing.
4. That the Town Clerk give notice of such Public Hearing at least ten (10) days prior to such hearing by publishing a copy of this Resolution once in the Webster Herald, the official newspaper of the Town of Webster, and posting a copy thereof on the Town Clerk’s Bulletin Board.
Seconded by Supervisor Nesbitt and duly put to a vote, which resulted as follows:
